These terms set out the conditions for using the themes, plugins and services (the "Services") provided by 369Theme (the "Site"), which is run by 369work ("we"). Please read them before using the Services.
1. Scope
These terms apply to all content, themes, plugins and custom development services provided through the Site. By using the Services, you are deemed to have agreed to these terms.
2. Free themes and plugins
The themes and plugins we publish on WordPress.org are distributed under the GNU General Public License (GPL v3). Use, modification and redistribution are subject to the terms of GPL v3.
3. Premium themes and plugins
Premium themes and plugins are sold through the Site and are distributed under the GNU General Public License v3 (GPL v3). Under GPL v3 you are free to use, modify and redistribute them. Copyright, however, remains with 369work.
Separately from the GPL v3 licence terms, the following services we provide are limited to the purchaser.
- Email support
- Provision of update files
Because these are digital products, refunds are generally not available once the download is complete.
Instead, if a premium theme or plugin does not work as shown on the demo site or overview page, we will fix it free of charge within the support period. This applies to sites that meet the WordPress.org server requirements. Problems caused by conflicts with other plugins are not covered.
4. Custom development
Custom orders begin with an enquiry through the order form and proceed on the basis of an individual agreement.
- If you cancel after work has started, a fee may apply depending on how far the work has progressed.
- Copyright is handled as set out in the individual agreement. Unless otherwise agreed, we retain the copyright and grant you the right to use the deliverables.
5. Prohibited conduct
- Reproducing or reusing, without permission, any content on the Site other than the themes and plugins (text, images, design and so on)
- Interfering with the operation of the Site
- Entering or sending false information
- Any other conduct that breaks the law or offends public order and morals
6. Disclaimer
We are not liable for the following.
- Any damage, direct or indirect, arising from use of the Services
- Any damage caused by sites linked from the Site (including external services such as WordPress.org)
- Malfunctions caused by changes such as WordPress updates or changes to your server environment
- Suspension or changes to the Services due to force majeure, such as natural disasters or network outages
7. Copyright
Copyright in the content on the Site (text, images, design and so on) and in the code of the themes and plugins belongs to 369work.
8. Changes to these terms
We may change these terms without notice when necessary. The revised terms take effect when they are posted on this page.
9. Governing law and jurisdiction
These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute relating to the Services.
